Distance Sales Agreement

This agreement sets out the rights and obligations of the Seller and the Buyer for token pack purchases made on comic-pad.com, in line with Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation. This is an English translation of the Turkish text; if the two differ, the Turkish version prevails.

1. Parties

SELLER

Seller: Berat Ölekli (sole proprietorship, trading as ComicPad)

Phone: +90 542 667 88 86

Email: info@comic-pad.com

Tax office / number: Dikimevi / 6540515879

Website: https://comic-pad.com

BUYER The person who buys a token pack on comic-pad.com. The Buyer's name, email, phone and billing address are the details the Buyer enters at checkout.

2. Subject

This agreement covers the sale and delivery of the following digital product ordered electronically on comic-pad.com: Digital token packs used for AI generation in ComicPad, such as covers, pages, narration, caricatures and live-stream actions. Tokens are an intangible (digital) product; nothing physical is shipped.

3. Product, Price and Payment

The name, token amount and price of each pack are shown in US dollars on comic-pad.com/pricing. Payment is taken in Turkish lira; the VAT-inclusive TRY amount shown on the checkout screen at the time of the order applies and is the amount charged.

Payments are taken by credit or debit card through Elekse Ödeme Kuruluşu A.Ş., a payment institution licensed by the Banking Regulation and Supervision Agency (BDDK), with 3D Secure verification. The Seller never sees or stores card details; they are processed on the payment institution's secure page.

An electronic invoice (e-arşiv) is sent to the email address the Buyer provides.

4. Delivery

As soon as payment is confirmed, the purchased tokens are added to the Buyer's ComicPad account and appear in the balance. Delivery is electronic and immediate; there is no shipping. If tokens are not added within 24 hours because of a technical problem, the Buyer can write to info@comic-pad.com, and the Seller will add the tokens or refund the payment.

5. Right of Withdrawal

Under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form or to intangible goods delivered to the consumer instantly.

Token packs are digital products added to the account at the moment of payment. At checkout, the Buyer ticks a box to ask for immediate delivery and to confirm that they understand they therefore lose the right of withdrawal. Payment cannot be completed without this confirmation. The confirmation is recorded with the date, time and account.

The absence of a right of withdrawal does not affect the refund cases in section 6.

6. Refund Cases

Duplicate charges, tokens that were never added to the account, and packs that cannot be used because of a technical fault on the Seller's side are refunded. Details are in the Refund Policy (comic-pad.com/legal/refund-policy).

7. Using Tokens

Tokens have no cash value; they cannot be exchanged for money, transferred to another account, and they do not expire. When an account is deleted, its remaining tokens are deleted too.

If a generation fails because of an error on the Seller's side, the tokens spent are returned to the account automatically. The token cost of each action is shown in the app and on the website.

8. Obligations of the Parties

The Seller must deliver the purchased tokens in full and provide the service in line with the Terms of Service.

The Buyer confirms that the details given at checkout are correct and that the card used belongs to them or is used with the cardholder's permission. Buyers under 18 must have permission from a parent or guardian.

The Buyer agrees to use ComicPad in line with the Terms of Service (comic-pad.com/legal/terms).

9. Personal Data

The Buyer's personal data is processed in line with the Data Protection Notice (comic-pad.com/legal/data-protection) and the Privacy Policy (comic-pad.com/legal/privacy).

10. Force Majeure

Neither party is liable for failing to meet its obligations while events outside its control last, such as natural disasters, war, epidemics, widespread infrastructure or power outages, or changes in the law.

11. Complaints and Disputes

For complaints and requests, contact the Seller at info@comic-pad.com or +90 542 667 88 86.

Disputes are handled, within the monetary limits announced each year by the Ministry of Trade, by the Consumer Arbitration Committee where the Buyer lives or where the transaction took place, and above those limits by the Consumer Courts.

12. Entry into Force

The agreement takes effect when the Buyer reads and accepts it and the Pre-Information Form at checkout and completes the payment. A copy is sent to the Buyer's email address; the current text is always available at comic-pad.com/legal/distance-sales-agreement.
